Fairfax, VA – Oct. 25, 2007 – On Tuesday, October 23rd, 2007, former Check ‘n Go employee and whistleblower William Harrod filed suit against his former company in DC Superior Court. The suit alleges a “nationwide conspiracy” on the part of Check ‘n Go and other payday loan companies, the Community Financial Services Association (CFSA) and others to “silence active and effective payday lending opponents”. The suit goes on to allege that Check ‘n Go executives fabricated allegations of wrongdoing against Mr. Harrod in order to defame his character. Even more disturbing is the assertion in the suit that Check ‘n Go execs hired private detectives to follow and intimidate whistleblowers, and to install spyware and tracking software on their computers.
The suit alleges that on September 18, 2007, Check ‘n Go execs fabricated charges that Harrod was a wanted sex offender. This information was communicated publicly, to members of the media, the community, and law enforcement. It is alleged in this lawsuit that Harrod was detained by authorities until they were able to verify that the charges were bogus. In addition, the suit alleges that a Waxahachie TX Private Detective named Brian Ingram was hired by Check ‘n Go to track and intimidate Harrod and other whistleblowers. In his fifth claim of harassment, Harrod alleges that Ingram, acting with an alias of Jeremiah Stone, caused tracking software to be downloaded to his personal computer.
“This type of behavior is consistent with how they treat their customers”, explains John LaCombe, the executive director of CapAmerica. “As long as you’re surrendering a stipend of your salary they play nice, but when people wake up and realize what this trap is then the lenders get nasty”. LaCombe directly compares this strategy to that which the payday lenders are employing toward whistleblowers. “When you don’t have a point based in fact, I suppose their only option is to attack their critics.” In a letter written to Check ‘n Go President David Davis, Lacombe compares the execs actions to that of the leader of a criminal syndicate. LaCombe states, “You would be better served by sharing fact, and not resorting to character assassination and intimidation tactics”.
Harrod’s suit was filed in Washington DC Superior Court. It lists several items on the complaint and demands damages in the amount of 95 Million Dollars.
